In compliance with Organic Law 3/2018, LOPD-GDD on the Protection of Personal Data and Guarantee and Digital Rights, European Regulation 2016/679, on the protection of personal data, GDPR and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, LSSICE, Ipae S.L. informs Users that a profile has been created on the social networks Facebook, Twitter, Instagram, LinkedIn and Youtube with the main purpose of providing information and advertising their products and services.

The User has a profile on the same Social Network and has decided to join the page created by Ipae S.L., thus showing interest in the information that is advertised on the Network. By joining our site, you provide us with your consent to the processing of personal data published in your profile.

The user can access the privacy policies of the Social Network itself at any time, as well as configure their profile to guarantee their privacy.

Ipae S.L. processes the User’s public information, especially their contact name. This data is only used within the Social Network itself and is not incorporated into any file.

In relation to the rights of access, rectification, cancellation and opposition, which you have and which can be exercised against Ipae S.L., you must take into account the following nuances:

  • Right of Access: It is the User’s right to obtain information about their specific personal data and the processing that Ipae S.L. has made or will carry out, as well as the information available on the origin of these data and the communications made or planned to be made of them. This right will be defined by the functionality of the Social Network and the ability to access the information in the Users’ profiles.
  • Right of Rectification: It is the right of the affected party to have the data that turns out to be inaccurate or incomplete modified. It can only be satisfied in relation to the information that is under the control of Ipae S.L. (for example, deleting comments published on the profile itself). Normally, this right must be exercised before the Social Network.
  • Right of Cancellation: It is the right to delete the User’s personal data, except as provided for in other applicable laws that determine the obligation to keep them, in a timely manner. This right may be exercised, for example, by disassociating the profile to which he or she is attached.
  • Right of opposition: It is the User’s right not to carry out the processing of their personal data or to cease the processing of the same by Ipae S.L. As with the right of cancellation, you can exercise, for example, by unlinking the profile to which you are attached.
  • Right to Limitation. The data subject may request the exercise of his/her right to restrict the processing of his/her data in cases where:
    • The Data Subject contests the accuracy of the data.
    • When the data collected is not needed for the purposes of the processing but is necessary for the recognition, exercise or defence of legal proceedings.
    • When the Data Subject opposes the processing while it is verified whether the legitimate reasons of the Data Controller prevail over those of the Data Subject.
  • Right to Portability. The Data Subject has the right to receive his/her personal data from the Data Controller to whom he/she has previously provided them, in a structured, commonly used and machine-readable format, with the aim of transmitting them to another Data Controller, without being prevented from doing so by the Data Controller to whom he/she had previously provided the data. In turn, the interested party, in the exercise of their right to portability, may request that their data be transmitted directly to the Controller to the Controller.
  • Right to Erasure and Oblivion. The Data Subject has the right to the deletion of his/her personal data when:
    • These are not necessary for the purpose for which they were collected
    • You have withdrawn consent and there is no legal basis to the contrary.
    • Your right to object to the processing of your data has been exercised and no legitimate grounds for such processing prevail.
    • The data is processed lawfully or must be deleted due to a legal obligation to which the Data Controller is subject.
    • The data have been obtained through a relationship with the Information Society service offer.

In order to exercise any of the rights described above, you must meet the following requirements:

  1. Submission of a letter addressed to Ipae S.L., at the address Narcís Monturiol, 10 1ª planta Local A, 08960, Sant Just Desvern, Barcelona or by email to ipae@ipae.es.
  2. The letter sent by the owner of the data requesting the exercise must comply with the legal requirements:

– Name, surname of the interested party and copy of the ID card. In the exceptional cases in which representation is admitted, it will also be necessary to identify the person representing him or her by the same means, as well as the document accrediting the representation. The photocopy of the ID card may be replaced as long as the identity is accredited by any other legally valid means.

– Request specifying the request. If you do not refer to a specific file, you will be provided with all the information that is available with your personal data. If you request information from a particular file, only the information from that file. If you request information relating to a third party, it can never be provided. If you request it by telephone, you will be instructed to do so in writing and will be informed of how you can do it and the address to which you should send it.

– Address for the purposes of notifications.

– Date and signature of the signatory

  1. Documents accrediting the request that is made.
  2. The interested party must use any means that allows accrediting the sending and receipt of the application.

Using the profile

Ipae S.L. will carry out the following actions:

  • Access to public profile information.
  • Publication in the User’s profile of all the information already published on the Ipae S.L. website.
  • Send personal and individual messages through the Social Network channels.
  • Page status updates that will be posted to the User’s profile.

The user can always control their connections, delete content that is no longer of interest and restrict who they share their connections with; therefore, you will need to access your privacy settings.

Publications

The User, once joined to the page of Ipae S.L., may publish comments, links, images or photographs or any other type of multimedia content supported by the Social Network. The user, in all cases, must be the owner of the same, enjoy the copyright and intellectual property rights or have the consent of the affected third parties. Any publication on the page, whether texts, graphics, photographs, videos, etc., that attempt or are likely to violate morals, ethics, good taste or decorum, and/or that infringe, violate or infringe intellectual or industrial property rights, the right to image or the Law, is expressly prohibited. In these cases, Ipae S.L. reserves the right to immediately remove the content, and may request the permanent blocking of the User.

Ipae S.L. will not be responsible for the content that a User has freely published.

The User must bear in mind that his/her publications will be known by other users, so he/she is also primarily responsible for his/her privacy.

The images that may be published on the page will not be stored in any file by Ipae S.L. but will remain on the Social Network.

Contests and promotions

Ipae S.L. reserves the right to hold contests and promotions, in which the User may participate in its page. The bases of each of them, when the Social Network platform is used for this purpose, will be published on it, always complying with the LSSICE and any other applicable regulation.

The Social Network does not sponsor, endorse or administer, in any way, any of our promotions, nor is it associated with any of them.

Advertisement

Ipae S.L. will use the Social Network to advertise its products and services. In any case, if you decide to process your contact details to carry out direct commercial prospecting actions, it will always be in compliance with the legal requirements of the GDPR and the LSSICE.

The fact of recommending the Ipae S.L. website to other Users so that they can also enjoy the promotions or be informed of its activity is not considered advertising.
